On Windows, the Desktop update preflight scan (hermes_cli._scan_venv_blockers)
classified only python -m http.server as a stoppable blocker. A hermes serve
or dashboard backend that survived the Desktop teardown (or was launched
manually) either dead-ended the hand-off with venv-blocked, or slipped past
it and kept venv\Scripts\hermes.exe mapped, so the updater quarantine
failed with os error 32 (#98336).
The CLI updater downstream already owns exactly this holder class with
positive-identity rungs: _ledger_reapable_backend_pids reaps dead-spawner
orphans and _ledger_manual_serve_holders stops manual serves and relaunches
them on their recorded host/port. Mirror the existing pausable-gateway
exemption: defer ledger-verified serve/dashboard holders to those rungs
instead of reporting them as blockers.
Identity is positive-only, per the #99558 guard contract: token-parsed
subcommand (never substring, #90778) + live-verified (pid, create_time)
ledger entry with matching purpose + provable ownership (spawner dead,
unrecorded, or the hand-off Desktop itself — an ancestor of the scan,
verified by pid+create_time). A backend supervised by any other live
process keeps blocking; ledger unreadable fails closed.

On Windows, the pre-update concurrent-instance gate aborted with exit 2
whenever ANY other process held the venv hermes.exe shim — including the
gateway itself, which _pause_windows_gateways_for_update() stops moments
later and the post-update restart phase brings back. Users with a running
gateway were forced into a manual taskkill dance before every update.
The gate now filters gateway runtimes out of the abort list and proceeds
when nothing else is concurrent. Classification delegates to
_is_pausable_gateway -> gateway.status.looks_like_gateway_command_line
(the canonical shlex-tokenized, profile-selector-aware matcher shared by
the Desktop preflight exemption and the venv-holder guard fallback), so
the gate's exemption and the pause machinery cannot drift apart. Anything
not positively identified as a gateway — REPLs, dashboard, Desktop
backend children, gateway MANAGEMENT commands like 'gateway status',
unreadable cmdlines — still aborts exactly as before, and the abort
message now lists only the PIDs that are actually the user's problem.
Surgical reapply of PR #37039 by @damadorPL onto current main (the gate
moved from hermes_cli/main.py to hermes_cli/update_cmd.py in the main.py
decomposition); his substring classifier was replaced with the canonical
matcher, which also fixes the 'hermes gateway status' misclassification
flagged in review.

Diagnostic run showed the venv shim makes every spawn a launcher/worker
chain: the child's direct parent is its own launcher (python.exe
child_scan.py), and the gateway-argv process is the grandparent. The
probe now finds the gateway ancestor by argv — the same way the pause
machinery would — and asserts THAT pid is visible to the scan.
On-demand workflow (fires only on wine2e/** pushes, never on PRs/main)
that runs a live venv-holder E2E on windows-latest: real spawned
processes with Hermes argv shapes, real detection/classification/
message code against the live process table. Tests pin CORRECT behavior
for the cluster issues (#90778 mislabeling, #78089 long-path exemption,
#87594 ancestor-exclusion, #81774 serve premise), so unfixed bugs fail
on the runner — empirical premise-check before the consolidation fix.
